The United Kingdom's departure from the European Union fundamentally altered the immigration landscape, replacing decades of free movement with a highly regulated, domestic immigration framework. For European citizens who had already established their lives in the UK, the transition brought significant anxiety regarding the future status of their non-European family members. Historically, bringing a non-European relative to the UK was a relatively straightforward process governed by European law. In the past, the primary route for these individuals was the eea family permit, a document that facilitated seamless entry and residence based on treaty rights. However, following the United Kingdom's departure from the European Union, the eea family permit route was formally closed. Today, in 2026, the immigration landscape requires applicants to navigate the EU Settlement Scheme, a domestic framework designed to protect the rights of European citizens and their families. Many applicants still mistakenly search for an eea family permit today, unaware that the legal framework has entirely changed and that attempting to apply under obsolete rules will lead to immediate confusion and delays.


The End of Free Movement and the Transition Period


To understand the current rules, it is essential to look at the legislative shift that occurred at the end of 2020. The Brexit transition period officially concluded on December 31, 2020. This date serves as the absolute cut-off point for establishing eligibility under the new rules. While it serves a similar purpose—allowing non-European family members to enter the country—it operates under entirely different legal authorities and requires different evidentiary standards. The focus is no longer on whether the European sponsor is exercising treaty rights as a worker or student, but rather on whether they hold valid status under the domestic settlement scheme and whether the family relationship existed prior to the critical December 2020 deadline.
